A tested approach to tribunals
Delphi's HR policies and legal advice can provide a strong framework for avoiding costly legal claims, but they cannot guarantee your workers will behave appropriately at all times.
We have an excellent track record of successfully defending businesses and organisations of all sizes against every type of employment tribunal claim.

Reacting to the claim
We can evaluate the strengths and weaknesses of any employment claim brought against your business and assess its potential value.
Delphi can attend any preliminary hearings on your behalf, handle all legal correspondence and ensure all tribunal orders and directions are complied with.
Challenging the claim
We will prepare your defence, identify and interview all relevant witnesses, draft their statements and prepare all court documents ready for the hearing.
At tribunal, our lawyers will present a robust defence of your position and rigorously cross examine the claimant’s witnesses – so your company stands every chance of defending any claim brought against it.
We can also provide a crisis communications team to manage personal and brand reputations, should the case attract unwanted media attention.

DAMAGES AND AWARDS AT TRIBUNAL
How much money do companies have to pay out after a tribunal?
Every day, employment tribunals across the country award large sums of compensation to successful claimants.
A breach of contract can cost your company up to £25,000, and unfair dismissal up to £89,493.00 for cases brought since April 2021, while compensation in discrimination cases is unlimited.
If a claimant has not found another job, or if their new employment pays less than you paid them, an employment tribunal can make an award for future loss of earnings.
You may also be ordered to refund HMRC for any Jobseeker’s Allowance, Income Support or Employment Support Allowance paid to the claimant after they were dismissed.
AFTER THE TRIBUNAL
What happens when a claimant appeals at tribunal?
If you win at an Employment Tribunal but the claimant appeals the judgement, Delphi can advise you on the best course of action, prepare your defence and represent you at any hearing before the employment appeal tribunal.
After the case has finished, Delphi will remain on hand to offer legal and HR advice, so that your business can quickly return to normal.
